Website Maintenance Terms & Conditions

These Terms & Conditions ("Terms") govern the website maintenance and support services provided by Webgrowth Digital Marketing LLC ("Webgrowth," "we," "us," or "our"). By paying for or utilizing our services, you ("Client," "you") acknowledge and agree to be bound by these Terms.
1. Scope of Services
Webgrowth offers website maintenance and support services, including:
- WordPress/CMS core, theme, and plugin updates
- Website backups and restoration support
- Uptime and performance monitoring
- Security scans and vulnerability detection
- Minor content and design edits (within agreed scope)
- Hosting management and DNS troubleshooting
Specific services delivered may vary depending on your maintenance plan or arrangement.
2. Hosting Infrastructure and Dependencies
Our services rely on third-party hosting infrastructure. While we actively monitor and manage your hosting environment, Webgrowth does not control the underlying server technology or data center performance.
We are not responsible for downtime, outages, or loss resulting from:
- Server or network failures
- Infrastructure maintenance or changes made by the hosting provider
- Security vulnerabilities, malware, or data loss related to server-side incidents
All server-side operations, backups, and performance depend in part on the terms and operational standards of our infrastructure providers.
3. Website Security and Malware
We implement standard security measures such as regular scans, plugin updates, and general hardening. However, no system is impenetrable.
We are not liable for:
- Malware infections or malicious attacks
- Data loss resulting from unauthorized access
- Exploits targeting outdated or custom third-party software
Malware cleanup services may be offered at an additional fee if required.
4. Backups and Data Recovery
Webgrowth performs routine website backups based on your selected service level. We do not guarantee:
- That backups will always be successful or complete
- That restoration will resolve all issues without further troubleshooting
We encourage clients to maintain their own independent backup routines when possible.
5. Client Responsibilities
Clients are responsible for:
- Providing accurate and timely access to websites, hosting accounts, and domain registrars
- Avoiding installation of unapproved plugins, themes, or scripts
- Informing us of major changes, development work, or integrations conducted outside our services
6. Service Availability and Limitations
While we aim to provide continuous service availability, you acknowledge that maintenance windows, network disruptions, or third-party issues may cause temporary unavailability. Webgrowth does not warrant uninterrupted service.
Support and routine services may be temporarily limited in the event of:
- Platform outages (e.g., WordPress.org, plugin vendor APIs)
- Hosting service disruptions or access restrictions
- Excessive client changes that exceed reasonable monthly maintenance scope
7. Liability Disclaimer
Webgrowth is not liable for any:
- Lost revenue, traffic, or leads due to website issues
- Damages caused by third-party tools, themes, or software
- Failures related to domain, DNS, SSL, or email misconfiguration
Our total liability under these Terms is limited to the fees paid by you for services during the 30 days preceding any claim.
8. Third-Party Terms
You understand and agree that some services we manage (including but not limited to hosting, domains, and backups) are governed by third-party terms, including the Hostinger Universal Terms of Service. By engaging with our maintenance service, you agree to comply with any relevant third-party terms as they relate to your website hosting and security.
9. Suspension or Termination
Webgrowth reserves the right to suspend or discontinue services at our discretion in cases of:
- Non-payment
- Security risks
- Misuse of access
- Repeated violations of service expectations
10. Modifications to Terms
We may update these Terms periodically. The most current version will always be accessible at webgrowth.io/website-maintenance-terms. Continued use of our services constitutes agreement with any updates.
11. Governing Law
These Terms shall be governed by the laws of the State of [Insert State], without regard to conflict of law principles.
